Lorsqu&rsquo;il n&rsquo;y a pas de motif de licenciement, les indemnit\u00e9s de fin d&#8217;emploi en vertu de la <a href=\"https:\/\/www.ontario.ca\/laws\/statute\/00e41\" target=\"_blank\" rel=\"noopener\"><em>Loi sur les normes d&#8217;emploi<\/em> (\u00ab LNE \u00bb)<\/a> doivent inclure deux types de paiements : le pr\u00e9avis l\u00e9gal et l&rsquo;indemnit\u00e9 de licenciement l\u00e9gale. Dans certains cas, les employ\u00e9s ont \u00e9galement droit \u00e0 un pr\u00e9avis raisonnable en common law. Ce blogue se concentre sur la mani\u00e8re de calculer l&rsquo;indemnit\u00e9 de licenciement l\u00e9gale en vertu de la LNE.   <\/p><h3>La formule : cinq ans de service et une masse salariale de 2,5 millions de dollars<\/h3><p>La LNE d\u00e9crit les formules de calcul du pr\u00e9avis l\u00e9gal et de l&rsquo;indemnit\u00e9 de licenciement l\u00e9gale. Le pr\u00e9avis l\u00e9gal est simple : les employ\u00e9s ont droit \u00e0 une semaine par ann\u00e9e de service, jusqu&rsquo;\u00e0 un maximum de huit semaines. L&rsquo;indemnit\u00e9 de licenciement l\u00e9gale est un peu plus compliqu\u00e9e. La formule suivante est g\u00e9n\u00e9ralement utilis\u00e9e : seuls les employ\u00e9s ayant au moins cinq ans de service, travaillant pour un employeur dont la masse salariale est d&rsquo;au moins 2,5 millions de dollars, ont droit \u00e0 une indemnit\u00e9 de licenciement l\u00e9gale d&rsquo;une semaine par ann\u00e9e de service, jusqu&rsquo;\u00e0 un maximum de vingt-six semaines. Bien que la d\u00e9termination de la dur\u00e9e de service soit simple, savoir si un employeur a une masse salariale de 2,5 millions de dollars n&rsquo;est pas toujours chose facile. Que se passe-t-il si l&#8217;employ\u00e9 n&rsquo;a travaill\u00e9 que dans un petit bureau en Ontario avec quelques autres coll\u00e8gues, mais que cet employeur a plusieurs autres bureaux \u00e0 travers le pays ou m\u00eame, \u00e0 l&rsquo;\u00e9chelle mondiale ? Comptons-nous la masse salariale des autres bureaux pour d\u00e9terminer si le seuil d&rsquo;indemnit\u00e9 de licenciement est atteint ? La r\u00e9ponse courte est oui.       <\/p><h3>La masse salariale totale \u2013 et non seulement celle de l&rsquo;Ontario \u2013 est utilis\u00e9e pour le calcul de l&rsquo;indemnit\u00e9 de licenciement<\/h3><p>Les tribunaux ont clairement indiqu\u00e9 que l&rsquo;obligation des employeurs de payer une indemnit\u00e9 de licenciement l\u00e9gale est bas\u00e9e sur la taille de leur masse salariale totale. Cela signifie que la masse salariale due \u00e0 un emploi en dehors de l&rsquo;Ontario ou m\u00eame en dehors du Canada doit \u00eatre incluse pour d\u00e9terminer si l&#8217;employeur a une masse salariale de 2,5 millions de dollars. Comme l&rsquo;a d\u00e9clar\u00e9 la Cour dans <em>Hawkes c. Max Aicher (North America) Limited<\/em>, 2021 ONSC 4290 :  <\/p><blockquote><p><em>Le calcul de la masse salariale en vertu de l&rsquo;<\/em><a href=\"https:\/\/nextcanada.westlaw.com\/Link\/Document\/FullText?findType=Y&amp;serNum=0280538896&amp;pubNum=135310&amp;originatingDoc=Ic4ea7d453d27205ee0540010e03eefe0&amp;refType=IG&amp;docFamilyGuid=Ib776388cf46611d99f28ffa0ae8c2575&amp;targetPreference=DocLanguage%3aEN&amp;originationContext=document&amp;transitionType=DocumentItem&amp;ppcid=6e4bf68ef9ca43fba3f733889e2215da&amp;contextData=(sc.UserEnteredCitation)\" target=\"_blank\" rel=\"noopener\"><em>art. 64 de la LNE<\/em><\/a> [la disposition relative \u00e0 l&rsquo;indemnit\u00e9 de licenciement l\u00e9gale]<em> n&rsquo;est pas limit\u00e9 \u00e0 l&#8217;emploi en Ontario ; l&#8217;emploi en dehors de l&rsquo;Ontario, y compris l&#8217;emploi en dehors du Canada, doit \u00eatre inclus.<\/em><\/p><\/blockquote><p>Le calcul de l&rsquo;indemnit\u00e9 de licenciement peut \u00eatre une affaire nationale \u2013 ou mondiale.
