C\u2019est ce qui s\u2019est produit dans l\u2019affaire <strong><em>Canada (Procureur g\u00e9n\u00e9ral) c. Santawirya<\/em>, 2019 CAF 248<\/strong>.<\/p>\n<p><strong><u>Chronologie et Contexte <\/u><\/strong><\/p>\n<p>Dans l\u2019affaire <strong><em>Canada (Procureur g\u00e9n\u00e9ral) c. Santawirya<\/em><\/strong>, la situation de Mme\u00a0Santawira s\u2019est d\u00e9roul\u00e9e de la mani\u00e8re suivante\u00a0:<\/p>\n<ul>\n<li>2000\u00a0: Mme\u00a0Santawirya est embauch\u00e9e par Industrie Canada en 2000.<\/li>\n<li>2012\u00a0: Mme\u00a0Santawirya est inform\u00e9e que son emploi serait touch\u00e9 par des mesures de contr\u00f4le des d\u00e9penses. Elle devient donc une \u00ab\u00a0fonctionnaire exc\u00e9dentaire\u00a0\u00bb avec une priorit\u00e9 de nomination. Ce statut lui donne le droit d\u2019\u00eatre nomm\u00e9e \u00e0 un autre poste au sein de l\u2019administration publique centrale avant tout autre candidat, pour autant qu\u2019elle poss\u00e8de les qualifications essentielles du poste.<\/li>\n<li>Octobre 2013\u00a0: Mme\u00a0Santawirya n\u2019a pas pu obtenir de poste dans la fonction publique et donc \u00e9t\u00e9 mise \u00e0 pied.<\/li>\n<li>25\u00a0octobre 2013 au 24\u00a0octobre 2014\u00a0: Mme\u00a0Santawirya avait droit \u00e0 une priorit\u00e9 de nomination suppl\u00e9mentaire, cette fois au titre de la \u00ab\u00a0priorit\u00e9 de mise en disponibilit\u00e9\u00a0\u00bb.<\/li>\n<\/ul>\n<p>Au cours de la p\u00e9riode du 25\u00a0octobre 2013 au 24\u00a0octobre 2014, pendant qu\u2019elle avait droit \u00e0 une priorit\u00e9 de mise en disponibilit\u00e9, Mme\u00a0Santawira postule pour un poste \u00e0 l\u2019Agence des services frontaliers du Canada (ASFC) \u00e0 deux reprises et est rejet\u00e9e dans les deux cas.<\/p>\n<p><strong><u>La d\u00e9cision de la Commission<\/u><\/strong><\/p>\n<p>Mme\u00a0Santawirya pr\u00e9sente un grief \u00e0 l\u2019encontre de la d\u00e9cision de l\u2019ASFC le 12\u00a0f\u00e9vrier 2015, affirmant avoir subi de la discrimination de la part de l\u2019ASFC en raison de son handicap, puisqu\u2019elle est une personne atteinte d\u2019un handicap et qu\u2019elle s\u2019est d\u00e9sign\u00e9e ainsi dans sa demande d\u2019emploi. L\u2019affaire a \u00e9t\u00e9 port\u00e9e devant la Commission des relations de travail et de l\u2019emploi dans le secteur public f\u00e9d\u00e9ral (la Commission), qui a d\u00e9cid\u00e9 que Mme\u00a0Santawirya avait le droit de d\u00e9poser un grief. La Commission a conclu que les faits substantiels \u00e0 l\u2019origine du grief s\u2019\u00e9taient produits <strong><em>avant<\/em><\/strong> qu\u2019elle ne perde son statut d\u2019employ\u00e9e. Autrement dit, la Commission a statu\u00e9 que, puisque Mme\u00a0Santawirya \u00e9tait techniquement toujours une employ\u00e9e lorsqu\u2019elle a postul\u00e9 et a \u00e9t\u00e9 rejet\u00e9e pour le poste \u00e0 l\u2019ASFC, elle pouvait d\u00e9poser un grief.<\/p>\n<p><strong>La D\u00e9cision de la CAF<\/strong><\/p>\n<p>La CAF n\u2019\u00e9tait pas d\u2019accord et a jug\u00e9 que la d\u00e9cision de la Commission \u00e9tait d\u00e9raisonnable. Devant la CAF, Mme\u00a0Santawirya a plaid\u00e9 que la question faisant l\u2019objet du grief concernait sa \u00ab\u00a0relation d\u2019emploi\u00a0\u00bb, puisqu\u2019elle avait droit \u00e0 la priorit\u00e9 de mise en disponibilit\u00e9 et qu\u2019elle avait d\u00e9j\u00e0 \u00e9t\u00e9 fonctionnaire. La CAF a rejet\u00e9 cet argument.<\/p>\n<p>Le paragraphe\u00a064(4) de la Loi sur l\u2019emploi dans la fonction publique (LEFP) indique clairement que les personnes mises \u00e0 pied en vertu du paragraphe\u00a064(1) de la LEFP cessent d\u2019\u00eatre des employ\u00e9es. Cela sugg\u00e8re qu\u2019une fois qu\u2019un membre est mis \u00e0 pied, un grief ne peut pas \u00eatre d\u00e9pos\u00e9. Cependant, le paragraphe\u00a0206(2) de la Loi sur les relations de travail dans le secteur public f\u00e9d\u00e9ral (LRTSPF) indique tout aussi clairement que les \u00ab\u00a0anciens fonctionnaires\u00a0\u00bb peuvent d\u00e9poser un grief dans des circonstances limit\u00e9es, telles que des mesures disciplinaires entra\u00eenant une suspension ou un cong\u00e9diement. La CAF a jug\u00e9 que la Commission n\u2019a pas\u00a0:<\/p>\n<ol>\n<li>Tenu compte de l\u2019interaction entre ces deux pi\u00e8ces l\u00e9gislatives (la LEFP et la LRTSPF).<\/li>\n<li>Articul\u00e9 les faits mat\u00e9riels survenus lorsque Mme\u00a0Santawirya \u00e9tait fonctionnaire.<\/li>\n<\/ol>\n<p>Depuis pr\u00e8s d\u2019un demi-si\u00e8cle, les tribunaux ont maintenu que <u>si les faits substantiels \u00e0 l\u2019origine d\u2019un grief se sont produits alors qu\u2019une personne \u00e9tait employ\u00e9e, cette personne a le droit de d\u00e9poser un grief<\/u>, m\u00eame si son emploi a pris fin par la suite.<\/p>\n<p>La CAF a expliqu\u00e9 que le paragraphe\u00a064(4) de la LEFP et le paragraphe\u00a0206(1) de la LRTSPF travaillent ensemble, dans le sens o\u00f9 la LEFP \u00e9tablit les param\u00e8tres \u00e0 l\u2019int\u00e9rieur desquels la plupart des faits substantiels doivent \u00eatre \u00e9tablis.<\/p>\n<p><strong>Conclusion<\/strong><\/p>\n<p>Le tribunal a jug\u00e9 que l\u2019interpr\u00e9tation du terme \u00ab\u00a0fonctionnaire\u00a0\u00bb au sens de la LRTSPF exigeait l\u2019existence d\u2019un lien entre les faits \u00e0 l\u2019origine du grief et la qualit\u00e9 de fonctionnaire de l\u2019employ\u00e9 plaignant. En bref, si les faits substantiels se sont produits pendant que la personne l\u00e9s\u00e9e \u00e9tait employ\u00e9e, alors la Commission a comp\u00e9tence, que la personne soit toujours employ\u00e9e lorsqu\u2019elle d\u00e9pose un grief ou non.<\/p>\n<p>Par cons\u00e9quent, la CAF a renvoy\u00e9 l\u2019affaire \u00e0 la Commission pour un nouvel examen de la cause de Mme\u00a0Santawirya. Cette affaire nous enseigne que les anciens employ\u00e9s doivent \u00eatre prudents lorsqu\u2019ils \u00e9valuent s\u2019ils peuvent d\u00e9poser des griefs pour des probl\u00e8mes survenus pendant leur mise \u00e0 pied ou pendant qu\u2019ils occupent un statut particulier en tant qu\u2019employ\u00e9s.
