Lindemnit\u00e9 de d\u00e9part vise \u00e0 combler l\u00e9cart financier pendant votre transition hors de votre poste, mais loffre initiale ne refl\u00e8te pas toujours tout ce \u00e0 quoi la loi peut vous donner droit.  <\/p><p>Une indemnit\u00e9 de d\u00e9part peut inclure une indemnit\u00e9 tenant lieu de pr\u00e9avis, le maintien des avantages sociaux, une compensation pour les vacances non utilis\u00e9es et dautres modalit\u00e9s. Toutefois, en droit ontarien, vos droits complets d\u00e9pendent de divers facteurs : votre \u00e2ge, votre anciennet\u00e9, votre niveau hi\u00e9rarchique, la nature de votre travail et le temps raisonnablement n\u00e9cessaire pour retrouver un emploi comparable. En raison de ces facteurs, de nombreuses offres dindemnit\u00e9 de d\u00e9part sont inf\u00e9rieures \u00e0 ce que lemploy\u00e9 a l\u00e9galement droit de recevoir.  <\/p><p>Les employeurs fixent souvent une date limite pour accepter une indemnit\u00e9 de d\u00e9part. Bien que ces d\u00e9lais puissent sembler fermes, ils sont fr\u00e9quemment n\u00e9gociables ou prolongeables, surtout lorsquun employ\u00e9 demande un avis juridique. Il est important de ne pas se sentir press\u00e9 de signer avant den comprendre les cons\u00e9quences.<br>Faire r\u00e9viser une indemnit\u00e9 de d\u00e9part, cest un peu comme faire inspecter une maison avant un achat important. Pour beaucoup de personnes, lindemnit\u00e9 de d\u00e9part est lun des plus importants paiements forfaitaires quelles recevront au cours de leur vie. Vous pourriez finalement confirmer que tout est en ordre, mais la diligence raisonnable est essentielle. Une r\u00e9vision approfondie permet de sassurer que vous ne passez pas \u00e0 c\u00f4t\u00e9 dune compensation, davantages ou de droits auxquels vous avez l\u00e9galement droit.     <\/p><p>Une fois une entente dindemnit\u00e9 de d\u00e9part sign\u00e9e, elle est g\u00e9n\u00e9ralement d\u00e9finitive, et il y a peu doccasion dy revenir ou de la ren\u00e9gocier.
