Adam Tracey is an associate lawyer at Nelligan O’Brien Payne LLP, and a member of the firm’s Intellectual Property Group. He manages a diverse practice that includes domestic and international patent prosecution across a wide range of technologies, foreign and domestic trade-mark prosecution, as well as associated litigation, contractual and opinion work related to all areas of IP and business law.

Adam’s patent practice involves a significant amount of patent drafting in a broad range of technical areas. These include software, internet, digital encryption, social-networking and digital advertising; industrial and manufacturing technology; agricultural and automotive technology; oil-field, clean-tech and turbo-machinery; construction and infrastructure technology and consumer goods.

Adam has drafted hundreds of patents filed worldwide, and prosecuted several hundred patents that have proceeded to grant in Canada. He also has experience managing international patent portfolios. He provides legal opinions relating to all areas of patent law, including due diligence, patentability, freedom to operate, infringement, validity, IP portfolio management and valuation opinions.

As a trademark agent, Adam has extensive experience with all aspects of trademark prosecution and litigation, including registrability and infringement opinions, filing and prosecution of trademark applications, cancellation and opposition proceedings, Federal Court litigation and management of international trademark portfolios. Adam also has experience preparing, filing and prosecuting industrial design applications both in Canada and around the world.

On the business law side of his practice, Adam has significant experience drafting and negotiating licence, software development, collaboration and settlement agreements related to businesses in a wide variety of spaces.

Adam’s clients range from start-ups and sole inventors, to blue chip multi-nationals. He advises them on issues relating to creative prosecution strategies that reflect any budgetary or tactical considerations that a particular client or case may require.

Adam enjoys the challenge of working with diverse and innovative technology each and every day. He also likes having a direct role in helping clients realize their dreams, and being their conduit for navigating the complex world of intellectual property law.

Outside of the office, Adam enjoys cooking, playing team sports (particularly soccer, ultimate and basketball) and playing the guitar.
