Our Construction Law group helps clients understand their rights and obligations, prevent problems where possible, and address disputes when they happen.

We work with builders, contractors, subcontractors, owners, developers, and suppliers, and we understand the practical realities of construction projects as well as the legal frameworks that govern them. Because construction matters often overlap with real estate, business law, and litigation, our team collaborates closely across these areas to give clients well-rounded, coordinated support.

Construction Liens

A construction lien is a legal claim that someone who has supplied labour or materials to a construction project can register against a property if they have not been paid. It is a way to secure payment by temporarily tying the debt to the land itself. In Ontario, lien rights are created and governed by the Construction Act, which sets strict deadlines for preserving and enforcing these claims. Missing a deadline can mean losing the right to claim payment through a lien.

We assist with:

  • Preserving and perfecting liens
  • Releasing liens or bonding them off title
  • Enforcing liens and defending against lien claims
  • Explaining obligations under the Act in clear, practical terms

Tarion & New Home Warranty Issues

For new residential construction, Ontario’s Tarion Warranty Corporation sets out warranty protections and procedural requirements. Both builders and homeowners have obligations under the system.

We advise on:

  • Tarion warranty coverage and defect claims
  • Builder obligations and compliance requirements
  • Dispute resolution and appeals
  • Coordination of repairs and settlements
