Construction Law Services
Team Leader:
Construction projects involve many moving parts including contracts, timelines, budgets, builders, trades, inspections, and property interests. With so many parties involved, legal issues can come up at almost any stage. Our Construction Law group helps clients understand their rights and obligations, prevent problems where possible, and address disputes when they happen.
We work with builders, contractors, subcontractors, owners, developers, and suppliers, and we understand the practical realities of construction projects as well as the legal frameworks that govern them. Because construction matters often overlap with real estate, business law, and litigation, our team collaborates closely across these areas to give clients well-rounded, coordinated support.
How we support
Contracts, Procurement & Project Planning
Well-structured contracts are one of the most effective ways to avoid disputes. We help our clients with:
- Drafting and reviewing construction contracts
- Negotiating terms with trades, suppliers, and project partners
- Advising on procurement methods and delivery models
- Identifying risks early and helping clients plan for them
Construction Liens
A construction lien is a legal claim that someone who has supplied labour or materials to a construction project can register against a property if they have not been paid. It is a way to secure payment by temporarily tying the debt to the land itself. In Ontario, lien rights are created and governed by the Construction Act, which sets strict deadlines for preserving and enforcing these claims. Missing a deadline can mean losing the right to claim payment through a lien.
We assist with:
- Preserving and perfecting liens
- Releasing liens or bonding them off title
- Enforcing liens and defending against lien claims
- Explaining obligations under the Act in clear, practical terms
Construction Disputes
Disputes can arise over delays, deficiencies, contract interpretation, payment, or change orders. We help clients assess their options and choose the most efficient path forward, whether that involves negotiation, mediation, arbitration, or litigation.
Our litigation team has significant experience with:
- Construction deficiency claims
- Breach-of-contract and payment disputes
- Delay claims and scheduling issues
- Multi-party construction litigation
Tarion & New Home Warranty Issues
For new residential construction, Ontario’s Tarion Warranty Corporation sets out warranty protections and procedural requirements. Both builders and homeowners have obligations under the system.
We advise on:
- Tarion warranty coverage and defect claims
- Builder obligations and compliance requirements
- Dispute resolution and appeals
- Coordination of repairs and settlements
Construction law is technical and time-sensitive. We focus on helping clients understand the process, meet deadlines, and make informed decisions at each step. Because our team works closely with our Real Estate and Litigation groups, we are well positioned to address construction issues that involve property rights, boundary concerns, easements, or court proceedings.
Whether you are planning a project, responding to a claim, or navigating a dispute, our team is here to help.
